Privacy Policy

The services offered by MusicTeam, as defined below and in the Terms of Use (“MusicTeam” or “we”), include the Site, and any other features, content, or applications which are defined in the Terms of Use, collectively, as the “MusicTeam Services”. A “User” is any person, business, or company that has browsed the MusicTeam Site, is a MusicTeam User (which means that you have registered with the Site or the MusicTeam Services, including but not limited to writers, labels, artists, publicist, publishing company, administrative company, and the like, or has used Site or the MusicTeam Services, whether knowingly or unknowingly).

MusicTeam is committed to providing a safe, secure User experience. We collect information about you when you interact with the MusicTeam Services, both by directly asking you to provide us with such information and by automatically collecting it, through use of technologies. When using any of our MusicTeam Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. Irrespective of which country you reside in or supply information from, you authorize MusicTeam to use your information in Canada and any other country where MusicTeam operates.

All definitions of terms in the MusicTeam Terms of Use document for the Site and the MusicTeam Services also apply to the present Privacy Policy and MusicTeam in the present Privacy Policy includes MusicTeam and the Exempted Parties as defined in the MusicTeam Terms of Use.

Information Collection

(a) User submitted information: MusicTeam collects User submitted information, such as, but not limited to, name, age, music genre, birth date, address, location, musical publishing information, favorite instruments, sound recording data, professional affiliations, unpublished and published song data, audio files, image data, information about songs and song titles, song lyrics, song details, song classification, e-mail address, written text, mobile number and data, video data, remarks, suggestions, graphics, tags, hashtags, genres, splits, ownership splits, identifiable numbers, identifiable codes, affiliated companies or individuals, rights holder, administrator, publisher, or any other materials (collectively, “Content” or “MusicTeam Content”) that you display, upload, transfer, publish, or post to MusicTeam.

(b) Anonymous information: MusicTeam may also log anonymous information including IP address, profile information, aggregate User data, mobile data, and browser type from Users of the MusicTeam Services (all information identified in paragraphs (a) & (b) is collectively known as “User Information”).

How the User Information is Used

(a) MusicTeam collects the User Information, which it may share with third parties, including approved sponsors, to provide more useful and personalized services. MusicTeam may share the User Information with partners such as SkyTracks.io for cross-marketing promotions, such as subscription offers and partner discounts. MusicTeam may use the User Information to send updates or news to the User. The User Information may be shared if it is legally required to do so, such as by a court order. The User Information may also be used by MusicTeam, its employees, agents, partners and affiliates, or any other Exempted Parties, to manage the Site, track usage, and improve the Site. Once User Information has been submitted, MusicTeam may share or disclose User Information to engage service providers or business affiliates, partners or other Exempted Parties, subject to confidentiality obligations consistent with this Privacy Policy. As we continue to develop our business, we might sell, buy, or license assets. In such transactions, User Information may be one of the transferred assets but remains subject to the promises made in this Privacy Policy. In the event that MusicTeam is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your User Information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.

(b) When you decide to post content, comments, or other materials to another member’s profile, or elsewhere on the Site or the MusicTeam Services, that information may be disclosed, and available to third parties consistent with the visibility settings for the relevant profile or content, even if those settings are inconsistent with your own profile Settings. Pages are generally publicly available, which means that posts that you make on those pages may be available to anyone. In addition, your Information Content and selections may be part of your profile as well as any content pages that you view. Similarly, if you connect to a public profile, the fact that you have connected to that public profile will be available to anybody with access to the Site or the MusicTeam Services.

(c) Delays and errors in effecting your profile and/or preferences may occur and we do not represent that they will be immediate, complete, error-free, current, reliable or accurate. Cookies

MusicTeam uses cookies to identify Users’ Internet browser, store Users’ preferences and mobile information. Data in cookies may be read to authenticate User sessions or provide services by MusicTeam or by any of its partners. You can program your computer to warn you each time a cookie is being sent, block third party cookies, or block all cookies. However, by blocking all cookies you may not have access to certain features on the Site or the MusicTeam Services.

Third-Party Advertising & Cookies

Ads appearing on the Site may be delivered to the User by MusicTeam or one of MusicTeam’s advertising partners. MusicTeam’s advertising partners may set cookies. These cookies allow the ad server to recognize a User’s computer. Ad servers may compile information about the location of a User. This information allows an ad network to deliver targeted advertisements. Advertisers’ uses of cookies are subject to their own privacy policies, not the MusicTeam Privacy Policy.

Analytics

MusicTeam may use third-party analytics providers and products to obtain, compile, and analyze information (that may include your profile, demographic information, usage information and/or device identifiers about how users are using and interacting with the Site and the MusicTeam Services. MusicTeam may provide such information to these analytics providers for the purpose of obtaining statistics and other information about how users are using and interacting with the Site and the MusicTeam Services.

These analytics providers may use their own Web Technologies to provide us with these services and may otherwise collect or have access to information about you, including your Profile Content, Demographic Information, Usage Information and/or Device Identifiers. We are not responsible for those third-party Web Technologies or activities arising out of them. We are not responsible for the effectiveness of or compliance with any third parties’ opt-out choices.

Links

MusicTeam utilizes links to or from other websites. MusicTeam is not responsible for the privacy policies and/or practices of those websites. When linking to another website, a User should read the privacy policy stated on that site.

Forums, Video, Chat Rooms, Message Boards and Personal Pages

Whenever a User voluntarily posts information to public forums, chat rooms, video pages, message boards and/or personal pages, that information can be accessed by the public to send User unsolicited communications. Any user posting information to a public forum does so at his/her own risk.

Promotions & Contests

MusicTeam may periodically send promotional materials or notifications related to the Site and the MusicTeam Services, or the services or products of MusicTeam partners, to the e-mail address you provided to us. By using the Site and the MusicTeam Services, you consent to the receipt of promotional materials or notifications to your e-mail address or profile(s).

We may offer sweepstakes, contests, and other promotions (“Promotion”) through the Site and the MusicTeam Services that may require registration. By participating in a Promotion, you are agreeing to official rules that govern that Promotion, which may contain specific requirements of you, including, allowing the sponsor of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion’s official rules, such as on a winners list.

Protecting Children’s Privacy

MusicTeam understands the importance of protecting children’s privacy in the interactive world. We do not use the MusicTeam Services to knowingly collect personal information from children under the age of 13 without parental consent. If you are a child under 13 years of age, you are not permitted to use the MusicTeam Services and should not send any information about yourself to us through the MusicTeam Services.

In the event that MusicTeam becomes aware that we have collected personal information from any child, we will dispose of that information in accordance with the Children’s Online Privacy Protection Act and other applicable laws and regulations. Security

MusicTeam has implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access and/or use. However, MusicTeam cannot guarantee the security of User Information. You understand that MusicTeam cannot and does not guarantee or warrant that files available for downloading, uploading, and/or viewing on the MusicTeam Services will be free of viruses, worms, Trojan horses or other code that may manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy particular requirements for accuracy of data input and output, and for maintaining a means external to this site for any reconstruction of any lost data. You will be solely responsible for the security of your password and the private settings related to Content.

Disputes

If there is any dispute about or involving this Privacy Policy, the User agrees that the dispute shall be governed by the laws of Quebec, Canada, without regard to conflict of law provisions, and the User agrees to EXCLUSIVE personal jurisdiction and venue in Montreal, Quebec, Canada. If an action is brought to enforce the terms of this Privacy Policy, then the prevailing party in that action shall be entitled to recover its costs and attorneys’ fees from the non-prevailing party.

Changes in Policy

MusicTeam has the right to change periodically this Privacy Policy without notice. MusicTeam will post all changes to its Privacy Policy on its Site.
